KSP 1.06 Smoking Policy
PURPOSE: To avoid the death or injury of any Reliable Tank Line driver or others and fully comply with FMCSRs. The procedure is as follows:
PROCEDURE:
- All drivers employed by Reliable Tank Line, LLC, being a transporter of hazardous Class 3 flammable materials and Division 2.1 flammable gases, shall comply with FMCSR § 397.13 Smoking, which states:
- A violation shall be made evident by visual observation and/or discovery of ashes, cigarette butts, or other smoking paraphernalia within 25’ of the truck and/or inside the cab of the truck.
- A violation shall NOT occur for use of a vaping device/e-cigarette or smoke-free tobacco products.
- Not following this procedure carries the following penalties, in addition to being sent home the rest of the work shift:
“No person may smoke or carry a lighted cigarette, cigar, or pipe on or within 25 feet of –
a motor vehicle which contains Class 1 materials, Class 5 materials, or flammable materials classified as Division 2.1, Class 3, Divisions 4.1 and 4.2; or
an empty tank motor vehicle which has been used to transport Class 3, flammable materials, or Division 2.1 flammable gases, which when so used, is required to be marked or placarded in accordance with the rules in § 177.823 of this title.”
PENALTIES:
1st Violation: 1-day suspension and $1,000 deduction from current period DSB Payout.
2nd Violation: 3-day suspension and loss of current period DSB Payout.
3rd Violation: further disciplinary action, up to and including, termination of employment.
